While I would agree that taking questions from
the public archives and reusing them on a commercial
web site is, at best, sleazy, it is not clear at all
as to whether that is illegal, or that any "damages"
are owed. Since these questions are donated without
apparent restriction, are free to the public, and are
available for easy downloading by anyone, mightn't they be
considered in the "public domain?" In which case, re-using
them might not be a copyright violation.

I'm
not a lawyer, and I certainly don't condone what Mr.
Beall is accused of; but I also think that wild
accusations made without first establishing for us that some
sort of copyright still applies to these questions is
reckless, uncalled for, and potentially libelous. Perhaps
some expert in copyright law would care to clarify
what rights, if any, pertain to archive
packets?
